Joe Jackson: 'He was my son and I can decide what to do on his behalf and in his honor.'The scent of failure and confusion pervaded the launch of a fragrance created in memory of the late Michael Jackson.
A deal between Joe Jackson, father of the deceased pop star and French fragrance entrepreneur Franck Rouas to create "Jackson's Tribute for Men" and "Jackson's Legend for Women" went sour last week due to disputes over who had the rights to the singer's name.
Bravado, the company that holds the commercial rights to sell products under Michael Jackson's name, filed in a Los Angeles court a day before the fragrances were to debut at a Las Vegas party.
The lawsuit said Rouas and Jackson were "unlicensed distributors who have been using the Michael Jackson trademark and/or a mark confusing similar thereto ... in connection with perfume that defendants are attempting to sell."
Bravado seeks a ban on the perfume's sale, as well as $150,000 in damages and $750 for each time Jackson's name is wrongfully used on a product.
Joe Jackson, 82, shrugged off any legal problems due to use of his deceased son's name. Jackson was notably excluded from his son's will.
"They can say whatever they want. I am the father, he was my son and I can decide what to do on his behalf and in his honor," said Jackson. "There are many interests around the legacy of my son, companies that want everything, but I have a foundation that allows me to launch projects with his name, the name of my son."
Jackson sounded conspiratorial as his plans for the fragrance dissipated.
"Some people will always try to prevent my efforts because they do not want me, and there are some media, like TMZ, that are against me," Jackson said, referring to the celebrity news website. "But they can't do anything."
The perfume's future is now uncertain due to legal battles and a growing ire between Jackson and the perfume maker, Rouas.
"I don't like the way he does things. But the initiative to create the scents was mine, and that plan goes ahead," he said.
The fragrances were reportedly inspired by flowers and plants that thrived around Michael Jackson's Neverland Ranch.
Michael Jackson died of drug intoxication in 2009.
Jackson's sister LaToya attempted to find a silver lining to the stinking mess.
"My family is delighted with this tribute to my brother from my father," she told APF.� "The scents are delicious."
